EULA - End User License Agreement

LICENSE AGREEMENT

This License is a legally binding agreement between you, an individual, and Excelsior LLC. ("Excelsior") for the Excelsior software product CCCalc accompanying this License (the "Software").

You agree that your use of the Software signifies that you have read this License, understand it, and agree to be bound by its terms and conditions.

TERMS AND CONDITIONS

1. This software product is licensed, not sold. Excelsior retains all rights to the Software.
2. This product is distributed free of charge.
3. You may install the Software to any number of computers and use for personal or business needs without any limitations.
4. You may create any number of backup copies of the Software.
5. You may provide a copy of the Software to any person or organization provided its original form retains unchanged.
6. You may not modify the Software.
7. You may not sell, rent or use any other way to gain profit by giving copies of the Software to persons or organizations.

LIMITED WARRANTY

THE SOFTWARE AND DOCUMENTATION ARE PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXCELSIOR FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE SOFTWARE AND DOCUMENTATION REMAINS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXCELSIOR OR ITS SUPPLIERS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE SOFTWARE.

Excelsior especially warns you that the Software is not intended for use in environments that human health or life may depends on. Such use of the Software is completely your own risk and responsibility.
